Constituent Assembly

The Constituent Assembly is a foundational political institution and concept representing a body of elected and nominated representatives specifically convened to draft and adopt a Constitution for a nation. The demand for it arose from the inadequacy of British-imposed frameworks, such as the Government of India Acts of 1919 and 1935, which retained British control over critical areas like defense and finance. The idea was first proposed by M.N. Roy in 1934, and the Indian National Congress officially demanded it in 1935.

The Assembly was formed in November 1946 under the provisions of the Cabinet Mission Plan (1946) to solve the problem of creating a constitutional framework that truly reflected India’s democratic aspirations and plural society. It first convened on December 9, 1946, and its work was guided by the Objectives Resolution, moved by Jawaharlal Nehru on December 13, 1946, which laid down the philosophy of a Sovereign, Democratic Republic. The mechanism involved extensive deliberation across various committees, notably the Drafting Committee chaired by Dr. B.R. Ambedkar. The Assembly adopted the Constitution of India on November 26, 1949, and it came into full effect on January 26, 1950.

The Assembly connects directly to the Constitution of India, which it produced, and the Indian Independence Act, 1947, which granted it full sovereignty. After its constitution-making task concluded, it functioned as the Provisional Parliament of India until the first general elections in 1951–52. The Constituent Assembly Debates are still cited by the Supreme Court and scholars to interpret the Constitution's meaning. As a historical body, the Constituent Assembly dissolved on January 25, 1950, and the concept itself remains the unamended source of India's constitutional supremacy.
