Industrial Disputes Act, 1947

The Industrial Disputes Act, 1947 (IDA) is a foundational labour law (Act) in India that provides a legal framework for the investigation and settlement of industrial disputes between employers and employees. It was enacted on March 11, 1947, and came into force on April 1, 1947, to address the industrial unrest and frequent lockouts that plagued the pre-Independence era due to the lack of a streamlined legal machinery. The IDA replaced the earlier Trade Disputes Act, 1929, whose main defect was that its proceedings for dispute settlement were not conclusive and binding on the parties.

The Act works by establishing mechanisms for the peaceful resolution of conflicts, including conciliation, arbitration, and adjudication through Labour Courts and Industrial Tribunals. It mandates internal mechanisms like the Works Committee and Grievance Redressal Committee to settle disputes. Key provisions regulate issues such as strikes, lockouts, layoffs, retrenchment, and closure of industrial establishments. For instance, Chapter V-B, introduced by the Industrial Disputes (Amendment) Act, 1982, lays down special provisions for establishments with 100 or more workers regarding layoff and retrenchment. The Industrial Disputes (Amendment) Act, 2010, further enhanced the law by providing direct access for workmen to Labour Courts or Tribunals for individual disputes.

The IDA is a central piece of Indian labour legislation and connects directly to the larger reform of the new labour codes introduced in 2020. These codes consolidate and update several existing labour laws, incorporating and modifying provisions from the IDA. While the IDA has been amended numerous times, such as in 1953, 1982, and 2010, its core objective of promoting industrial peace and protecting workers’ rights during retrenchment and closure remains.
