Union Cabinet

The Union Cabinet is a constitutional institution and the highest decision-making body within the executive branch of the Government of India. It is the inner core of the larger Council of Ministers (CoM), consisting only of the Prime Minister and the senior-most ministers, who typically head crucial ministries like Finance, Defence, and Home Affairs.

The concept of a Council of Ministers, headed by the Prime Minister to aid and advise the President, was present in the original Constitution under Article 74 and Article 75. However, the term "Cabinet" was formally introduced into the Constitution only in 1978 through the 44th Constitutional Amendment Act. This amendment inserted the term into Article 352, defining it as the council consisting of the Prime Minister and other ministers of Cabinet rank appointed under Article 75. This addition was a direct response to the internal emergency of 1975, ensuring that the President could only proclaim an emergency after receiving a written decision from the Union Cabinet.

The Cabinet functions as the central policy-making body, determining major government policies on matters like foreign affairs, national security, and economic development. Its primary mechanism is the principle of Collective Responsibility, enshrined in Article 75(3), which mandates that the entire Council of Ministers is collectively responsible to the Lok Sabha. This means a no-confidence motion passed against any minister requires the entire Cabinet to resign. The Cabinet also advises the President, and this advice is binding after reconsideration, as per Article 74.

The Cabinet is closely connected to the Council of Ministers (CoM), which is a broader body that includes Cabinet Ministers, Ministers of State (MoS), and Deputy Ministers. While the CoM is a larger body that rarely meets as a whole, the smaller Cabinet meets frequently to transact government business and enforce collective responsibility. The Cabinet also utilizes Cabinet Committees, which are extra-constitutional bodies set up under the Transaction of Business Rules to reduce the workload and enable detailed examination of specific issues. Recent changes often involve reshuffles of the Union Cabinet, where ministers are dropped, promoted, or reassigned to different portfolios, reflecting political and organizational realignments.
